Terms of Service

Last updated: 2026-06-08

This is a private pilot

Hommamia is in a closed development phase. It is shared with a small group of test users only and is not a publicly launched commercial service.

We have not yet completed business registration, tax registration, food-business licensing, or formal payment-provider integration in any jurisdiction.

Payments during the pilot are a manual workaround. Orders are coordinated through PayPal links and the platform operators manually verify that funds landed before marking an order as paid. There is no licensed escrow during the pilot.

By using the platform during this phase, you accept that you are participating in a pilot test, at your own risk, with no commercial guarantees of any kind. If you are not comfortable with that, please do not use the platform yet.

1. What Hommamia is

Hommamia is a discovery platform that helps independent home cooks list dishes and helps diners find them. During this pilot it also helps coordinate payment manually between the two.

Hommamia is not the cook, not a restaurant, not a delivery service, not (yet) a licensed food business, and not (yet) a licensed payment provider. Cooks prepare and sell their dishes directly. Diners buy directly. Hommamia simply makes it possible for them to find each other and to coordinate.

The legal contract for any order is between the cook and the diner. Hommamia is not a party to it.

2. Accepting these Terms

By creating an account, using the site, placing an order, or accepting an order, you confirm that you have read and accepted these Terms and the pilot notice above. If you do not accept them, please do not use the platform.

3. Who can use Hommamia

  • You must be at least 18 years old.
  • You must provide accurate information about yourself.
  • One account per person. Keep your password secure.
  • You have been invited or otherwise given access to this pilot. Hommamia is not open to the general public yet.

4. If you are a cook: your responsibilities

When you list and sell dishes on Hommamia, the responsibility for everything that happens with the food is yours. Specifically:

  • Comply with all local laws. This includes any licensing, business registration, hygiene inspections, food handler certificates, and tax registration that apply where you cook and sell. Hommamia does not check or vouch for any of this.
  • Food safety and hygiene are entirely yours. Ingredient quality, storage temperatures, preparation, packaging and handling are your job. You bear all liability for illness, allergic reactions, or harm caused by your food.
  • Ingredient and allergen disclosure must be accurate and complete. You are responsible for any harm caused by missing, incorrect, or misleading ingredient information.
  • Taxes. You set your prices. You are responsible for declaring and paying any taxes owed on what you earn.
  • Fulfillment. You are responsible for fulfilling the order at the agreed time, in the agreed condition, at the agreed location.
  • Pickup and delivery. Coordinate directly with the diner. Hommamia does not deliver anything.
  • Honest listings. Photos, descriptions, portion sizes, and availability must match what you actually sell.
  • Prohibited items. No alcohol, no cannabis, no raw or unsafe items banned by local law, and nothing you are not licensed to sell.

5. If you are a diner: your responsibilities

  • You are buying home-cooked food made by an independent person in a home kitchen, not by a licensed restaurant. Accept this risk before ordering.
  • Read the ingredients every time. If you have allergies, intolerances, or specific dietary requirements, confirm them directly with the cook before paying. Hommamia cannot verify what is in any dish.
  • Pay through the platform. Do not arrange off-platform payments to avoid fees, escrow, or platform records.
  • Coordinate pickup or delivery politely and on time with the cook. Show up. Communicate.
  • Treat the cook respectfully. No abuse, harassment, discrimination, or threats.
  • Inspect food on receipt. Use the in-app messaging and the dispute flow promptly if there is a real problem.

6. What Hommamia does — and does not do — during the pilot

What we do:

  • Host listings and run search and discovery.
  • Generate the PayPal links used to coordinate payment, and manually verify that payments landed.
  • Provide an in-app messaging thread per order.
  • Act as an informal mediator if something goes wrong.

What we do not do:

  • Cook anything.
  • Inspect any kitchen.
  • Verify any cook’s licenses or certifications.
  • Verify ingredient or allergen accuracy.
  • Deliver food.
  • Operate a licensed payment service or regulated escrow.
  • Guarantee taste, quality, freshness, punctuality, or that any specific dispute will be resolved a specific way.

Listings, photos, ingredient lists, and contact information are user-generated content provided by cooks and diners. Hommamia does not pre-verify it.

7. Payments, fees, and refunds during the pilot

  • Payment runs through a manual PayPal workaround, not a licensed escrow or payment-institution flow.
  • Hommamia is not a licensed payment service provider and is not acting as one.
  • Refunds, if any, are coordinated manually, on a best-effort basis, between the cook, the diner, and the Hommamia operators. There is no guaranteed refund right under these pilot Terms beyond what consumer law would mandate directly against the cook.
  • Cooks are solely responsible for declaring and paying any taxes on amounts they receive, including amounts routed through the pilot.

8. Disputes during the pilot

If food does not arrive, is unsafe, or has a real issue, message the cook first using the order chat. Hommamia operators may informally mediate using the chat, photos, and timestamps, but any decision we make is a best-effort pilot operations call, not a legal judgment.

Either party may pursue legal remedies directly against the other. Hommamia is not a party to that dispute.

9. Reviews and content

Reviews and other content you post must be honest, written by you, and not abusive, harassing, defamatory, or unlawful. Hommamia may moderate or remove content at any time.

10. Account suspension and termination

We may suspend or close accounts that break these Terms, harm other users, or expose Hommamia or its operators to legal risk. No notice is required.

11. Disclaimers and limitation of liability

Please read this section carefully — it is the legally important part.

  • The platform is provided “as is” and “as available”, with no warranties of any kind, especially given its pilot and development status.
  • Hommamia is not a party to the food sale. The contract is between the cook and the diner.
  • Hommamia is not liable for foodborne illness, allergic reactions, injury, property damage, missed pickups, late deliveries, no-shows, payment failures, lost PayPal transfers, or any loss caused by a cook, a diner, or anything either party does or fails to do.
  • To the maximum extent allowed by law, the total liability of Hommamia and its operators to any user is limited to the amount that user paid to Hommamia directly — which during the pilot is zero — and in any case is capped at €50.

12. Indemnity

As a cook or a diner, you agree to defend and indemnify Hommamia and its operators from any claims, damages, or costs that arise from your own conduct, your food, the accuracy of your disclosures, or your breach of these Terms.

13. Changes to these Terms, and shutting the pilot down

We may update these Terms at any time. The “Last updated” date at the top of this page controls. Continued use of the platform after a change means you accept the change.

Because this is a pilot, we may also pause, restrict, or shut the platform down at any time, with or without notice, and we have no obligation to continue service. Active orders at that moment will be coordinated to a reasonable close on a best-effort basis.

14. Governing law and contact

Governing law and dispute jurisdiction: [to be set before the pilot is opened more widely].

Contact for legal and platform questions: [contact email to be set before the pilot is opened more widely].

The fact that these details are not yet filled in is itself consistent with the pilot disclosure at the top of this page.
